Terms of service

Terms of Service

1. Definitions

In these terms and conditions:

  • “We”, “us” and “our” means Mornings & Tails, the business described in section 2.
  • “You” means the consumer: a natural person who is not acting in the course of a trade, business or profession, and with whom we enter into a distance contract.
  • “Distance contract” means a contract concluded between you and us without both of us being physically present at the same time, using only means of distance communication such as our online store and email.
  • “Cooling-off period” means the 14-day period within which you can exercise your right of withdrawal.
  • “Right of withdrawal” means your right to cancel the contract within the cooling-off period without giving a reason.
  • “Subscription” means our recurring supplement subscription, as described in our Subscription Terms.

3. Applicability

  1. These terms apply to every offer, order and contract between you and us, unless we have expressly agreed otherwise in writing.
  2. Our products are sold to consumers. These terms are made available to you before you place your order, and you can read, save and print them at any time from our website.
  3. If any provision of these terms is found to be invalid, the remaining provisions remain in full force. We will replace the invalid provision with a valid one that comes as close as possible to its original purpose.

4. Our offer

  1. Every offer contains a complete and accurate description of the products, including their relevant characteristics and any restrictions. Our supplements are intended for dogs older than 12 weeks.
  2. Our offers are shown on the product page, together with photos, the product name and the relevant product information.
  3. All prices include VAT and any other mandatory taxes. Any delivery costs are shown separately before you complete your order.
  4. Obvious mistakes or errors in our offer do not bind us.

5. The contract

  1. The contract is formed when you accept our offer and the terms that apply to it by completing your order.
  2. After you place your order, we confirm the contract by email. This confirmation includes information about how to exercise your right of withdrawal.
  3. We may refuse an order if there is an obvious error, if you do not meet our terms, or if there are reasonable doubts about the accuracy of the information you provided.
  4. We keep a record of the contract in our administration for up to 7 years, in line with our legal record-keeping obligations, and can make it available to you on request.

6. Right of withdrawal

  1. When you buy physical products, you have a cooling-off period of 14 days to cancel the contract, starting on the day you receive the product.
  2. You do not have to give a reason.
  3. To withdraw, contact us via the contact page on morningsandtails.com or use the model withdrawal form in our Refund & Returns Policy. A clear statement by email is also sufficient.
  4. For a subscription, the cooling-off period starts on the day after you receive the first delivery.
  5. If we have not informed you about your right of withdrawal, the cooling-off period is extended by up to 12 months after the end of the original cooling-off period.

7. Costs and consequences of withdrawal

  1. If you withdraw from the contract, we will refund the full amount, including standard delivery costs, within 14 days of the day you notified us of your withdrawal. We refund using the same payment method you used, unless we agree otherwise.
  2. You pay the cost of returning the product.
  3. You must send the product back within 14 days of the day you notified us of your withdrawal.
  4. You may only handle the product as you would in a physical shop. If the product has lost value because you handled it more than necessary to assess it, we may deduct that loss in value from your refund.

8. Exclusions from the right of withdrawal

The right of withdrawal does not apply to products that are sealed for health protection or hygiene reasons once you have broken the seal. This applies to our supplements: once the seal of the packaging has been broken, the statutory right of withdrawal no longer applies. This does not affect our voluntary 30-Day Empty-Jar Guarantee described in section 10.

9. Prices

  1. All prices are shown in pounds sterling (GBP) and include VAT and other mandatory taxes.
  2. Any delivery costs are shown clearly before you place your order.
  3. If the VAT rate or another mandatory component of the price changes, we may adjust our prices accordingly.
  4. When we show a discount, the reference price is the lowest price we charged for that product in the previous 30 days.
  5. We are not bound by obvious typing errors or mistakes in prices.

10. Conformity and guarantee

  1. We make sure our products match the contract, the description on the product page and the expectations you may reasonably have of them. This is your statutory right to conforming goods.
  2. If a product is faulty, you can choose repair or replacement free of charge. If that is not possible within a reasonable time, you are entitled to an appropriate price reduction or to cancel the contract.
  3. You do not have to inspect the product for defects on receipt. Please report a defect within a reasonable time after you discover it.
  4. In addition, we offer a voluntary 30-Day Empty-Jar Guarantee on our supplements: if a product did not work for your dog, contact us within 30 days of your order and we will refund you in full. No forms, no photos and no return shipping are needed. The full conditions are set out in our Refund & Returns Policy. This guarantee never limits your statutory rights.
  5. Our dog supplements are complementary feed, not medicines. If you are unsure whether a product is suitable for your dog, consult your vet.

11. Delivery

  1. We aim to deliver within 2 to 7 days, unless we have agreed otherwise with you.
  2. In any case, we deliver no later than 30 days after your order. If we cannot deliver within the agreed period, we will let you know and you may cancel the contract free of charge.
  3. We ship free of charge and with tracking. The carrier may differ per shipment; we mainly use Relay and Royal Mail.
  4. The risk of loss of or damage to the product passes to you when the product is delivered to you or to a recipient you have designated.

12. Payment

  1. You can pay by credit or debit card, PayPal, Klarna, Apple Pay or Google Pay.
  2. Paying in advance does not mean you waive any of your rights.
  3. If you have been charged incorrectly or twice, we will inform you straight away and refund the amount.
  4. Please let us know as soon as possible if you notice any errors in your payment details or payment.

13. Subscriptions

  1. Our subscription costs £33.95 per delivery. The delivery frequency is shown before you complete your order.
  2. You can cancel your subscription at any time via your customer account or by contacting us. After you cancel, no further payments are taken.
  3. Subscriptions are never pre-selected at checkout. You only start a subscription if you actively choose one.
  4. When you sign up and in your confirmation email, we clearly explain the renewal, the price and how to cancel. You can always cancel in the same way you signed up.
  5. Our Subscription Terms contain the full details. These provisions do not affect your statutory rights, including your right of withdrawal for the first delivery.

14. Complaints

  1. Please report any complaint about a product or our service within a reasonable time after you discover the problem, via the contact page on morningsandtails.com.
  2. We respond to complaints within 14 days. If your complaint needs more time, we will let you know within that period and tell you when you can expect a full response.
  3. We treat all complaints confidentially and in consultation with you.

15. Governing law and disputes

  1. These terms and all contracts between you and us are governed by Dutch law.
  2. As a consumer, you keep the protection of the mandatory consumer laws of the country where you live, including the United Kingdom. Nothing in these terms limits those rights.
  3. If we cannot resolve a dispute together, you may bring it before the competent court. As a consumer, you can in principle bring a claim before the courts of the place where you live.

16. Changes to these terms

  1. We may change these terms. Changes do not apply to orders already placed or contracts already concluded.
  2. We publish updated terms on our website before they take effect.
  3. Every contract is governed by the terms that applied at the time you placed your order.
